Does disputing inputs in a permanent mod constitute refusing the mod?

I am working on a foreclosure mediation in which the bank offered the borrower a permanent HAMP loan modification for a Freddie Mac loan.  The borrower neither explicitly accepted nor declined it, but told the bank that several of its inputs (income, home value, etc.) were erroneous and supplied supporting information.  After requiring the borrow to resubmit everything and scheduling a second mediation session, the bank now says the borrower declined the modification and the bank is not…See More

Alison Moss is a member of the ADR and Environmental Law and Land Use Sections of the WSBA. She has than twenty seven years of experience in land use and environmental law. Throughout her career, she has been an active force in environmental and planning issues in the Pacific Northwest. Alison's projects have ranged from working for citizen environmental groups; to advising local governments; to representing private applicants, including master planned communities, builders, contractors, and individuals in the land development process.

Alison speaks frequently on land use issues and has authored numerous articles including Washington Lawyers Practice Manual chapter on Wetlands. She has twice been an associate editor of the Washington Bar Association Real Property Deskbook and has been named a "Super Lawyer."
