This is the place for members interested in legislative matters affecting ADR in Washington. The Legislative Committee is tasked with monitoring legislation that may be of interest to our members and making recommendations to the Executive Committee.

SUPRREME COURT PROPOSES COLLABORATIVE LAW RULES

On April 5, 2013 the Washington Supreme Court entered an Order on the adoption of Collaborative Law Rules.   A copy of the order is here:  Aoril 5 2013 Order on adoption of Collaborative Law Rules

Comments on the proposed Rules may be made to the Court within 60 days of the publication of the proposed Rules.

It might be noted that the Rules adopted by the Washington Supreme Court were recommended by the WSBA Rules Committee as recommended by the ADR Section of the WSBA and the  ADR Section's Legislative Committee.

Budget thought: I'd like to see us fund a scholarship/fellowship for 2013 with the thought this would reinstitute the program we had before and be an on-going project. Unlike this year, with advance planning it could be more merit-based and include all three law schools. Could be a great way to engage with them. Unlike the previous program we stopped, this time I'd like to see it each year focus on providing an academic research product on a subject that advances our mission. We could set the topic or use the applicants' ideas as criteria. (This program doesn't necessarily need to be a LegComm-thing at all, but since we did it in 2012, we can be the ones to suggest it for 2013.)

FYI, ExecComm approved a motion for a scholarship this summer to provide legal research project regarding the intersection of the UMA and foreclosure mediation programs. Paul's tied-up in trial, so I'll start the two things that need to happen:

  • get authorization from WSBA Dep Dir for Finance for spending from fund balance, and how to make payments to the scholar;
  • contacting Alan Kirtley, which the motion explicitly said we should seek to coordinate with.

I'll keep all apprised here, and if anyone else wants to be in on those discussions, let me know and I'll copy you in. (Paul, you'll be copied-in, of course!)

Rep. Orwall just informs that the FFA amendments, amended onto HB 2614, just passed the house.

Kathryn's update:

Finally, some good news…in the great tradition of The Princess Bride, the FFA was only mostly dead after the coup on the Senate floor this past Friday…and Rep. Orwall and others have moved mountains and they figured out a way to resuscitate the FFA.

Last night, the FFA (HB 2421) wasamended onto HB 2614, an act relating to residual debts following short sales of owner-occupied residential property secured by deeds of trust.  The title of the bill has also been amended and will now be:  An act relating to assisting homeowners in crisis by providing alternatives, remedies, and assistance.  (Note:  Changing the title of a House bill is very difficult to do, so they must have full agreement in the House on this maneuver.) 

The bill was voted off the Senate floor 47-1.  We’re not quite done -- it now goes back to the House for final passage…

Kathryn advises that it appears both our bills - UCLA and FFA amendments - were part of the collateral damage to the parliamentary maneuver on the Senate floor last night. They and all other unpassed policy bills are now dead for the session. Unless there's some legislative defib equipment we don't know about, it looks like they're gone.

Kathyrn Leathers advises that the FFA technical fix bill is now on it's last leg of it's journey, on the Senate floor.
