Amendment to Foreclosure Fairness Act
HB 2421/SB 6364. Click here to track the old FFA amendment bill; it's been amended toHB 2614 which you can track here. It does have the ADR Section's #1 priority: immunity from liability for all mediators. It has passed the legislature and is on for signature by the Governor. Here's the bill as passed.

Comment by Jeff Bean on March 20, 2012 at 11:48am FYI, ExecComm approved a motion for a scholarship this summer to provide legal research project regarding the intersection of the UMA and foreclosure mediation programs. Paul's tied-up in trial, so I'll start the two things that need to happen:
I'll keep all apprised here, and if anyone else wants to be in on those discussions, let me know and I'll copy you in. (Paul, you'll be copied-in, of course!)

Finally, some good news…in the great tradition of The Princess Bride, the FFA was only mostly dead after the coup on the Senate floor this past Friday…and Rep. Orwall and others have moved mountains and they figured out a way to resuscitate the FFA.
Last night, the FFA (HB 2421) wasamended onto HB 2614, an act relating to residual debts following short sales of owner-occupied residential property secured by deeds of trust. The title of the bill has also been amended and will now be: An act relating to assisting homeowners in crisis by providing alternatives, remedies, and assistance. (Note: Changing the title of a House bill is very difficult to do, so they must have full agreement in the House on this maneuver.)
The bill was voted off the Senate floor 47-1. We’re not quite done -- it now goes back to the House for final passage…

Comment by Jeff Bean on March 3, 2012 at 11:52am Kathryn advises that it appears both our bills - UCLA and FFA amendments - were part of the collateral damage to the parliamentary maneuver on the Senate floor last night. They and all other unpassed policy bills are now dead for the session. Unless there's some legislative defib equipment we don't know about, it looks like they're gone.
