Here's the new mediator's certification form from Commerce or from Commerce's Foreclosure Fairness Program page. Always check with Commerce directly for forms and information, though we'll try to keep the links here current.

Commerce has issued guidance clarifying when the 2012 amendments, ESHB 2614, apply:

  • The date Commerce receives a referral to mediation will determine whether or not the changes in ESHB 2614 will apply to the mediation.
  • For all referrals received by Commerce on or before June 6, 2012, the changes in ESHB 2614 will not apply.
  • For all referrals received by Commerce on June 7, 2012 or later, the changes in ESHB 2614 will apply.
  • Commerce will identify the referrals subject to ESHB 2614 on the assignment letter sent to all parties.

Here's a summary of the legislative activity on the FFA, from the WSBA ADR Section perspective. We'll be discussing this in a panel at the section'sAnnual Meeting 10:30 tomorrow, Friday May 4, preceeding the Northwest Dispute Resolution Conference. Y'all are coming to the conference, right?

Gov. Gregoire signs ESHB 2614 on March 29. There's no emergency clause for the portions amending the FFA. So 90 days would be June 27. Here's the bill as-passed.

Comment by Jeff Bean on March 8, 2012 at 9:59am

Yes, I don't recall and don't see an emergency clause for the FFA portions of the bill. So it's my understanding it's on the normal timeline for becoming effective. Someone confirm my recollection that it's 90 days after Governor's signature?
