Please join the ADR and Business Law Sections, litigators, corporate counsel, employment and transactional attorneys for an informative program on creating effective dispute resolution clauses that “fit the form to the fuss.”

As lawyers, arbitrators and mediators, the Presenters have seen “the good, the bad and the ugly” and the consequences which flow from a well-drafted (or poorly drafted) ADR clause. Using cases and commentary, learn the importance of, among other things:

  • Identifying drafting issues that must be considered and appropriately addressed
  • Properly defining the parties and scope of the issues subject to ADR
  • The Consequences of Poor Drafting
  • The Benefits of Good Drafting
  • What disputes are best resolved through judicial litigation, arbitration, mediation, or a “stepped” combination
  • If arbitration or mediation, should it be administered or ad hoc/non-administered?
  • The Clause itself -- Complicated? Simple?
  • Using plain (and careful!) English: Say what you mean and mean what you say

Course materials will include a lengthy hand-out discussing cases and illustrating the concepts discussed..
